Simply put, arbitration is a commercial-type forum for resolving commercial disputes, and although the sophisticated safeguards of the legal system are often not available, the need for prompt and private dispute resolution seems to convince most of our commercial clients to include arbitration clauses in most of their contracts. In fact, some of our clients consider that the refusal to accept an arbitration clause by the other party negotiating a contract is reason enough to reconsider the entire transaction, as they feel that rejecting such an effective dispute resolution system is too aggressive. And for clients accustomed to non-U.S. legal systems, arbitration seems to be a welcome and familiar way to resolve disputes and protect the rights of the parties. What is an arbitration agreement? This is usually a clause in a broader contract in which you agree to settle any dispute that arises with your counterpart amicably through arbitration. Arbitration agreements are common in consumer and employment contracts, but they can be additions to any contract negotiation when one or both parties want to avoid the possibility of future lawsuits. According to the American Arbitration Association (AAA), this is the general arbitration process. Arbitration sounds like a term you may have found in a labour dispute a few decades ago, but it`s becoming more and more common in the business world. You`ll constantly encounter it in employment contracts, credit card agreements, and retail contracts, so it`s good to know what it means and how arbitration works. In particular, you may have seen a mandatory arbitration clause in a contract. Not all arbitration proceedings are subject to a single set of rules or procedures.
As mentioned earlier, the parties can choose their own rules and procedures. Professional arbitrators sometimes develop their own rules and procedures, although these can vary greatly depending on the service.
